SMART RENT CAR RENTAL AGREEMENT - STANDARD TERMS AND CONDITIONS

Note: "Owner" refers to Smart Rent Car Rental. "Renter" refers to the person renting the vehicle.

1. Delivery & Return

  • The vehicle is delivered to the Renter in good condition and without apparent defects.
  • Any complaints as to the condition must be made to the Owner immediately upon delivery.
  • The Renter agrees to return the vehicle with all documents and accessories and in the same condition to the Owner at the same location and on the designated date and time in this agreement.
  • The Owner reserves the right to retrieve the vehicle without demand or notice if used in violation of this agreement.

2. Damage, Loss, Theft, etc.

  • In the event of damage, loss, or theft of the vehicle or parts (including fire and breakage of glass), the Renter shall, irrespective of fault, pay the Owner for all costs and expenses. This includes, but is not restricted to:
    • Replacement or recovery costs.
    • Repair costs.
    • Compensation for decline in value and loss of rent fees.
  • This liability may be waived if the Renter accepts Loss Damage Waiver (LDW) according to Clause 10 by signing the "Accept" space on the front page, provided the Renter complies with all Terms and Conditions.
  • LDW may not relieve the Renter if the Renter has not obtained a Police Report.
  • If the police report is not in a position to identify the Third Party, Smart Rent Car Rental reserves the right to recover the excess liability (AED 7,500) from the customer.
  • Customers are responsible for tire damage and punctures.

3. Charges

  • Renter shall pay any charges shown on the front page or mentioned in this agreement.
  • Security Deposit is returned 21 days after for returned cars.
  • If the car is returned 2 hours later than the time due, an additional charge of a full day will apply.
  • Traffic Fines are charged as per the actual fine plus an Admin Fee.
  • The Salik (Toll Gate) charge is AED 5 per Toll Gate.
  • Vehicle must be returned with the Full Fuel Tank; an additional charge of AED 220 will apply otherwise.

4. Indemnity

  • The Owner is only responsible for loss or damage suffered by the Renter or Third Parties if it was caused intentionally or through gross negligence on the Owner's part.
  • In all other cases, the Owner cannot accept liability, and the Renter shall hold the Owner immune against such claims.

5. Conditions of Use & Restrictions 🚫

  • The Renter must look after the vehicle carefully and, in particular, not allow it to be used:
    • In any race, test, or rally.
    • For any custom, regulation, or purpose not provided on the front page of this agreement.
    • Outside the country unless specified in the agreement (geographical area restrictions apply).
  • Renter must be over 25 years old (for Locals and Residents) and their license must be more than One year old.

6. Insurance Policy

  • The owner provides insurance coverage to persons using the vehicle with its permission (and not otherwise) in accordance with an automobile liability insurance policy which is available for inspection. In case of any accident by a person from his/her mistake, they must pay insurance expenses amount & 20% extra for the vehicle parts.

6. Prohibited Activities & Fines:

  • Desert/Restricted Areas Driving NOT ALLOWED: AED 5,000 Fine & All Damage Cost.
  • Race Tracking is NOT ALLOWED: AED 5,000 Fine & All Damage Cost.
  • Off-Roading, Rallying, Racing or Drifting is NOT ALLOWED: AED 5,000 Fine & All Damage Cost.
  • Smoking is NOT ALLOWED: AED 1,000 Fine & All Damage Cost.
  • Driving over 160 km/h is NOT ALLOWED:
    • 2nd attempt: AED 2000 Fine.
    • 3rd attempt: The car will be shut down, and the remaining rental period will not be refunded.

8. Personal Data

  • The Renter acknowledges that personal-related data to this rental agreement is subject to automated process.
  • The Renter expressly agrees that this data can be communicated to third parties, especially for credit protection purposes.

9. Accidents, Thefts

  • In case of an accident, with or without damage, or any personal injuries, the police must be called to the scene.
  • The Renter must insist on obtaining a "Police Report".
  • In case of theft of the vehicle or parts, the Renter must report it to the police and obtain a "Police Report," which must be forwarded to the Owner immediately.
  • Any damage or loss must be reported to the Owner immediately.
  • Renter must secure all data of all parties and witnesses to complete an accident report.
  • Under no circumstances must claims by third parties be accepted by the Renter.
  • No repairs are to be carried out on the vehicle without the prior consent of the Owner.

10. Government Law & Jurisdiction

  • This Agreement shall in all respects be governed by and be construed and interpreted and take effect in accordance with the laws of the United Arab Emirates. applicable to the Emirate where it is executed and the parties hereby irrevocably submit to thenon-exclusive jurisdiction of the courts of such Emirate.

11. Loss Damage Waiver (LDW)

  • By initialing the "Accept" space on the front page, the Renter accepts the obligation to pay a supplementary fee.
  • LDW does NOT exempt from liability in case of:
    • Gross negligence.
    • Deliberate contravention of the rental conditions, legal limitations, or insurance conditions.

12. Language

  • In the event of a conflict between the English and Arabic texts of this agreement, the English text shall govern in any interpretation.

13. Cancellation Policy

  • 30 days or more before pick-up date: 40% penalty from the security deposit.
  • 14 days or less before pick-up date: 50% penalty from the total rent amount.
  • 7 days or less before pick-up date: 75% penalty from the total rent amount.
  • 2 days or less before pick-up date: 100% penalty from the total rent amount.
  • In case of No-Show on the agreed time and date: 100% penalty from the total rent amount.
